Contract document
Terms and conditions
Last updated: 19 October 2026
Version: 2026.10.19
These terms govern use of the Bookfilo platform. Please read them before creating an account, publishing an accommodation listing or purchasing a subscription.
1. Platform operator and contract
The Bookfilo platform is operated by [DENUMIREA LEGALĂ A OPERATORULUI], tax ID [CUI/CIF], registration no. [NR. REGISTRUL COMERȚULUI], with its registered office at [SEDIUL SOCIAL], România (“Bookfilo”, “we”). You can contact us at [email protected] or [TELEFON].
The platform-use contract is concluded between the operator and the user. If you use Bookfilo for a company or another organisation, you confirm that you have authority to legally bind it.
2. What Bookfilo is and is not
Bookfilo provides infrastructure for presenting accommodation listings, managing availability and rates, sending booking enquiries, communication, reviews and digital services for hosts.
The accommodation contract is between the host and the guest. The host sets the price, availability, taxes, rules, cancellation and stay refunds. Bookfilo supplies the platform and does not become the accommodation provider. Guests may pay at the property or, where the host has an eligible connection, online through the payment provider identified before confirmation. Bookfilo facilitates the technical flow and records payment status; accommodation rules and host obligations remain separate from Bookfilo subscriptions.
Sending an enquiry with payment at the property does not automatically confirm a booking; the host accepts or declines it. For online payment, confirmation depends on the verified payment result and the conditions displayed in the flow. Read the summary, booking status and host rules before treating the stay as confirmed.
3. Eligibility and account
You may create an account if you are at least 18 and have full legal capacity. Information supplied must be true, complete and up to date.
You are responsible for the devices, password, passkeys and sessions associated with your account. You must notify us without delay if you suspect unauthorised access. You may also sign in through Google or Apple, in which case the selected provider’s terms also apply.
Transferring your account, using another person’s identity, abusive automation or bypassing security measures and technical limits is prohibited.
4. Host obligations
The host is responsible for the legality of their activity, authorisations, classifications, tax obligations, consumer protection, premises safety and compliance with local rules.
The title, description, photos, facilities, location, capacity, rates, availability and policies must be accurate. Hosts must not publish misleading, discriminatory or unlawful material, or material for which they lack the necessary rights.
The host is a separate controller for guest data received to manage the enquiry and stay and must provide their own privacy notice where required by law.
4a. Host data sharing addendum
For the transmission and handling of an enquiry, Bookfilo and the host are separate controllers, each for their own purposes and means. This addendum governs data sharing; it does not automatically make the host a processor for Bookfilo. A distinct activity carried out solely on behalf of another controller requires an Article 28 GDPR agreement where applicable.
The host uses guest names, contacts, stay details and messages only for the enquiry, accommodation communications, contract performance, legal obligations and complaints. The host must document legal bases, provide their own privacy notice, set retention periods and handle guest rights requests.
The host must keep data confidential, restrict access to people who need it, impose confidentiality duties, apply appropriate security and enter into agreements with their own providers where required. Hosts must not sell data or reuse contacts received through Bookfilo for advertising, marketing lists or unsolicited messages. Any separate guest subscription to marketing must be voluntary, informed and demonstrable; submitting an enquiry does not provide that permission.
The host must notify Bookfilo at [email protected] without undue delay and, contractually, within 24 hours of becoming aware of a breach affecting data received through the platform. The initial report includes available information about the incident, affected data, consequences, measures and a contact person; missing information follows later. This does not replace the host’s own assessment or notifications to authorities or guests, including the GDPR 72-hour deadline where applicable.
The host cooperates in incident investigations and access, correction, erasure and restriction requests. Deleting a Bookfilo account does not delete independent host copies; the host remains responsible for retaining or deleting them lawfully.
5. Guest obligations
Guests must provide correct information, use the host’s contact details only for the enquiry and comply with the rules communicated by the host. Any payment, deposit, cancellation, damage or accommodation complaint must be resolved directly with the host.
Bookfilo may retain technical evidence of the enquiry and facilitate communication without taking over the host’s or guest’s contractual obligations.
6. Paid host subscriptions
Some host functions require a subscription linked to a property. The price, currency, billing frequency and included functions are displayed before payment. Stripe processes payments and card details; Bookfilo does not store the full card number or CVC.
If the offer specifies automatic renewal, the subscription renews until cancelled. The host may cancel future renewal; access normally remains active until the end of the period already paid for. Changing plans may start a new billing cycle according to the summary shown before confirmation.
Withdrawal, cancellation and refunds are governed by the Withdrawal and Refund Policy. These terms do not limit mandatory consumer rights.
7. Artificial intelligence functions
At the host’s express request, Bookfilo may generate a proposed property description. The result is a draft that may contain errors and must be checked, corrected and approved by the host before publication.
We do not use AI to decide booking confirmation, a person’s eligibility, individual accommodation prices or the exercise of a right. Full details are in the Artificial Intelligence Policy.
8. Content, reviews and intellectual property
You retain rights in uploaded content. While we host it, you grant us a non-exclusive, worldwide, royalty-free licence strictly to store, technically adapt, display and promote the listing within the service.
Reviews may be checked for a connection to an enquiry and moderated. We may remove illegal, fraudulent, offensive, irrelevant or infringing content in compliance with the rules applicable to online platforms.
Bookfilo’s brand, interface, code and own materials may not be copied, resold or exploited without permission.
8a. Listing order and promotion
The “Promoted” section shows up to 12 properties: those with an active Ultra plan first, then other properties by total score if spaces remain. Within each group, properties in the page’s relevant country take priority, followed by descending score and descending identifier for ties. The section can therefore include properties without an Ultra plan; presence in the section alone does not establish an individual purchase of that position.
Location, dates, capacity, property type and facility filters first determine eligible listings. Standard ordering uses a total score combining the active plan, photo quality, views, favourites, shares, phone reveals and any administrative adjustments. The plan can have a substantial influence: Entry adds 1,000 points, Premium 5,000 and Ultra 10,000; each counted interaction adds one point, while average photo quality adds up to 20. A higher plan can therefore outweigh engagement contributions. Promoted placement is commercial and carries the “Promoted” label; it is not an independent quality endorsement and does not guarantee bookings.
The “Popular” badge is calculated separately each week using the preceding 90 days. Properties must be publicly eligible, at least 30 days old, and have at least two confirmed/completed bookings with checkout in the period or three approved reviews in the period. The top 2% of eligible properties receive the badge, rounded down; fewer than 50 eligible properties means no badge is awarded. Bookings have the largest individual contribution; views, favourites, shares, phone reveals, review counts and average ratings also contribute, with caps on each activity volume. Interactions identified as bots are excluded. Payment, photos and administrative adjustments do not enter the badge calculation.
The Popular badge does not remove commercial influence from display order: listings in the Popular section use the standard total score for ordering. Distance may take priority in nearby results; filters and page context affect which listings appear. The score is not personalised using an individual guest behavioural profile.
9. Availability, changes and suspension
We use reasonable care to ensure availability and security but do not guarantee uninterrupted operation. Maintenance, errors, incidents or external provider outages may occur.
We may restrict or suspend an account for security risks, non-payment, fraud, legal breaches or repeated breaches of these terms. For removals or restrictions based on illegal content or breaches of the terms, we provide the reasons required by law: the measure and duration, relevant facts, legal or contractual basis, automation involvement and available redress, subject to specific statutory exceptions. Professional hosts also receive applicable notices and reasons under Regulation (EU) 2019/1150.
Users may request account closure in settings. The account is deactivated and deletion is scheduled after a 30-day period during which it can be cancelled. The Privacy Policy explains which resources are removed and why a guest’s enquiries and reviews do not automatically disappear from the host’s history.
9a. Reporting content and challenging measures
Users and authorities can contact Bookfilo in Romanian or English at [email protected]; this is the service contact point, including for illegal-content reports. Identify the exact listing or review URL, explain why the content is considered illegal and provide relevant supporting information. Include your name and email for a response, subject to statutory exceptions, and a statement that the information is accurate and complete to the best of your knowledge and submitted in good faith.
Do not post identity documents or sensitive information publicly. Reporting does not automatically result in removal. You can request reconsideration of moderation or restriction measures at the same address, identifying the account or content, decision and reasons for your challenge. Statutory rights to contact authorities and courts remain available.
10. Liability
Each host is responsible for their accommodation and services, and each user for their own statements and actions. Publication of a listing alone does not mean that Bookfilo guarantees a host’s classification, quality, availability or identity.
Within the limits of the law, we are not liable for indirect loss or loss arising from the direct host–guest contract or third-party services. No clause excludes liability that cannot legally be excluded, including for fraud, intentional misconduct, attributable injuries or mandatory consumer rights.
11. Applicable law, complaints and changes
Romanian law governs these terms. Before taking legal action, we encourage you to send your complaint to [email protected]. Consumers may contact ANPC and use the ADR mechanism at https://anpc.ro/sal/. The European ODR platform closed on 20 July 2025.
Competent courts are determined by law; consumers retain mandatory protective rules applicable to their residence. Material changes are communicated through an appropriate channel before application. For professional hosts covered by Regulation (EU) 2019/1150, we notify Terms changes on a durable medium, such as email, at least 15 days in advance, or longer where adaptation requires it, subject to statutory exceptions. The revision date does not replace notification or make changes retroactive. The preceding snapshot is available in the document archive.
